Terms and Conditions

I. Definitions

The following terms used in these Terms of Service shall mean:

  1. Client – hall mean the natural person, legal person, or organizational entity not being a legal person, but to which special regulations granted a legal capacity to place the Payment Order;
  2. Consumer – according to art. 22[1] of Civil Code the consumer shall be deemed to be any natural person who performs actions in law which are not directly connected with his professional or business activity;
  3. Civil Code – Act of 23 April 1964 (Dz.U. No. 16, item 93, with subsequent amendments);
  4. Terms of Service – the following Regulations providing services by electronic means as part of online wholesaler hurt.wassyl.pl;
  5. Internet Store (Store) – the Internet Store operating at hurt.wassyl.pl through the agency of which the Customer is able to place Orders;
  6. Goods – products presented in the Internet Store;
  7. Sale Agreement – the contract for the sale of Goods (within the meaning of the Civil Code), concluded between WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa Plac Orląt Lwowskich 2A, 53-605 Wrocław REGON: 366118962, NIP: 8971832776 and a Client with the use of the Internet Store service;
  8. Consumer Protection Act – the Act of 30 May 2014 on consumer rights (Dz.U. from 2014, item 827);
  9. The Act on provision of services by electronic – the Act of 18 July 2002 on provision of services by electronic means (Dz. U. No 144, item 1204 with subsequent amendments);
  10. GDPR – Regulation (EC) No 679/2016 of the European Parliament and of the Council of 27 April 2016 on the rules on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation);
  11. Wholesale Account - an active account in the Store www.hurt.wassyl.pl, whitch enables placing wholesale Orders.
  12. Order – Customer's declaration of will that leads to signing of a Sales agreement, describing in particular the type and number of Products.

I. General Provisions

2.1. The following Regulations define the general rules for the use of Internet Store available at: hurt.wassyl.pl.

2.2. These Regulations are regulations, as described in the paragraph 8 of the Act on electronic service.

2.3. The Internet Store operating at: https://hurt.wassyl.pl, is owned by hurt.wassyl.pl WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa Plac Orląt Lwowskich 2A, 53-605 Wrocław REGON: 366118962 NIP: 8971832776.

2.4. These Regulations define in particular:
a) the rules concerning registration and using the account created with the said Internet Store;
b) the terms and conditions of placing Orders online in the said Internet Store;
c) the rules of concluding Sales Agreements through the Internet Store.

2.5. Using the Internet Store is only possible when the ICT system used by the Client meets at least one of the following minimal technical requirements: a) Internet Explorer version 9.0 or newer b) or any other browser compatible with w.w.

2.6. In order to use the Internet Store, Clients should gain access to a computer or other device with the Internet access on their own.

2.7. Clients can access the Terms of Service at any time through the link available on the, download the document and make a hard copy.

III. Terms and Conditions of Using the Internet Store

3.1. The commencement of use of the Internet Store hurt.wassyl.pl is conditioned upon registration of Wholesale Account on the Store's website.

3.2. Registration of a Wholesale Account is made by the Store service on the basis of the registration form filled by a Client (available on the Store’s website).

3.3. Registration is conditioned upon accepting the Terms of Service and providing your personal data marked as obligatory.

3.4. The Store service reserves the right to refuse the registration of Wholesale Account in justified cases - in particular when Client’s company profile is not related to trading of household chemicals. In cases justified by the company's interests and the confidentiality of data, the Store reserves the right to grant an individual service to any given contractor, in particular to large entities or entities linked to the suppliers cooperating directly with our company. Granting the status of an individual service means lack of possibility to register such entity on wholesale platform. The stationary trading of household chemicals shall be understood as having a stationary wholesale, store or market stalls selling the articles mentioned above. In justified cases, the B2B platform service may request the Client to supplement the data confirming the trading of household chemicals and to send additional information concerning business activity to verify correctness of registration process, i.e.:
a) store address with the photo
b) market stalls address with the photo Provision of the data is voluntary but necessary to complete the account activation.

3.5. In the case of violation of these Regulations, the Store service may immediately terminate Client’s right to use the Internet Store and limit access to a part or the whole Store’s assortment – in particular, when the Client:
a) while registering on the Online Store, provides untrue, inaccurate or invalid data, misleading information or information which infringes the rights of third parties,
b) infringes, through the online store, personal rights of third parties, especially personal rights of other online store clients,
c) Undertakes activities considered by hurt.wassyl.pl as illegal in accordance with currently effective laws or general rules of the Internet use or activities that may tarnish the reputation of WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa.
d) Without permission and prior authorisation copies, reproduces or uses web content of any channel of sale owned by WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa, in particular photos and descriptions created by WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa. If there is any evidence of using copyrighted photos or descriptions, Store service will immediately block access to the contents of the Store. In addition, WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa may call for immediate cessation of using materials owned by the company.

3.6. The person deprived of the right to use the Internet Store shall not be able to re-register without obtaining the consent from hurt.wassyl.pl first.

3.7. In order to ensure messaging security in relation to services provided, the Internet Store shall take appropriate technological organizational measures that comply with the threats to the safety of the services provided, especially the measures that prevent acquisition and modifications of the personal details submitted on the Internet by unauthorized persons.

3.8. The Client shall in particular be obliged:
a) not to send or forward any messages whose content is banned under mandatory provisions of law, e.g. messages which popularize violence, infringe personal and other rights of third parties, as well as slander third parties,
b) to use the Internet Store in a manner that shall not cause any interruptions to its functioning, in particular by using specific software or devices,
c) not to send or place unsolicited commercial information (spam) in the Internet Store,
d) to use the Store in an inoffensive and easy way for other clients and hurt.wassyl.pl,
e) to use any content placed with the said Internet Store for personal use only,
f) to use the Internet Store in accordance with the currently effective Polish provisions of law, provisions contained herein as well as general rules of the Internet use.
g) the Account is free of charge but to keep it active it is necessary to place one Order per month. Persons logging in only to check prices and not placing any orders will lose their Accounts on the platform,
h) verification of the Account activity follows on monthly basis.

IV. Sale Agreement Procedure

4.1. Information about the Goods presented on the Internet Store website, in particular their descriptions, technical and performance parameters as well as prices, constitute an invitation to conclude an agreement as defined in Art. 71 of the Civil Code.

4.2. In order to enter into a Sales Agreement via the Internet Store, the Client is required to go to website and select Goods performing the necessary activities based on the information available on the website and messages displayed on the screen.

4.3. The Client selects Goods by adding them to the basket.

4.4. During Ordering - until the moment ofpressing "Order and Pay" - the Customer has the right to modify the details submitted and the Products chosen. To do this it is essential to follow the on-screen instruction.

4.5. Once all necessary information has been entered by the Client, a summary of the Order will be displayed. The said summary shall include the following information:
a) the subject of the contract,
b) unit and total price of the ordered Goods, including shipping costs and any other costs (if applicable),
c) selected payment option,
d) selected shipping option,
e) delivery time,
f) comments.

4.6. For the Order to be sent the Client must accept the Terms of Sale, provide his/her personal data marked as obligatory and press the "Order and Pay" button.

4.7. Placing such an Order by the Client shall constitute the declaration of will of entering into a Sale Agreement with hurt.wassyl.pl in accordance with this Regulations.

4.8. Upon placing the Order, the Client shall receive an email entitled "Confirmation of Order No. [...]", with the final confirmation of all vital Order details.

4.9. The contract shall be considered concluded at the moment of receiving the email mentioned above.

4.10. The Sales Agreement is is concluded in the Polish language with the content in accordance with the Terms of Service.

4.11. Clients can access the Terms of Service at any time through the link available on the www.hurt.wassyl.pl, download the document and make a hard copy.

4.12. Recording, securing and making Order data and general arrangements available (Terms of Service) shall be effected by sending an e-mail.

4.13 Store hurt.wassyl.pl is providing a wholesale platform directed to entrepreneurs trading stationary (wholesale or retail) clothing products for women.

4.14 Minimum wholesale order value is 1000 PLN + VAT.

V. Delivery

5.1. Goods can only be delivered area of Rzeczpospolita Polska and to the address provided by the Client when placing the Order.

5.2. The ordered Goods are delivered by courier. The costs of delivery are available HERE. The costs of delivery will also be indicated at the time of the Order.

5.3. Time limits for delivery is 3-14 working days from the day of placing the Order by the Customer. The information about the realistic delivery date is sent via e-mail after each Order.

VI. Price, methods of payment and VAT invoice.

6.1. The prices of Goods are provided in the Polish zlotys (PLN) and include all components, such as VAT tax (price rates specified), duty fee and any other components.

6.2. The Client may pay for the Goods:
a) by money transfer to the bank account available on the contact page and after placing the Order.
b) by PayU,
d) by cash upon delivery of the Order.
e) by a pay card. Payment cards are operated by PayU.

6.3 The default form of sending invoice is sending it in electronic form. The acceptance of these Regulations is at the same time the acceptance of sending the invoice in electronic form in the meaning of the VAT Act.

6.4. VAT invoice is the only valid sale document to the orders placed on the wholesale platform.

6.5. Invoices in electronic form will be generated in PDF format (Portable Document Format) to avoid any modification of invoice details, in particular:
a) edition of the document content,
b) commenting,
c) filling or signing fields of the document,
d) custom changes of the document,
e) copying document content,
f) page splitting.

6.6 There is no possibility to issue several sale documents for one Order. Only one document (VAT invoice) can be issued for the whole Order.

VII. Complaints Related to Goods

7.1. WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa as a seller answers to the Client who is a Consumer, as described in the art. 221 of the Civil Code, on a warranty for defects specified in the Civil Code, in particular art. 556 and art. 556[1] – 556[3] and the following.

7.2. Complaints resulting from infringement of the Client's rights either those legally guaranteed or contained herein, need to be sent on the e-mail address indicated on the contact page. WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa commits itself to consider the complaint within 14 days. A failure to consider the complaint within prescribed time limit shall be regarded as unjustified.

7.3. WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa is the distributor and the manufacturer of the goods at the same time. In that case we have a responsibility from the guarantee of the goods sold under conditions and for the period defined by the law regulations.

VIII. Complaints Related to Rendering Electronic Services

8.1. WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa undertakes the actions in order to secure the proper functioning of the Store in a way that results from the current technical knowledge, and commits itself to remove all the irregularities reported by the Customers within a reasonable period of time.

8.2. The Client shall be obliged to immediately notify WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa about any irregularities or interruptions in the functioning of the Internet Store website.

8.3. The Client can inform about any irregularities in the functioning of the Internet Store in writing to: WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa Plac Orląt Lwowskich 2A, 53-605 Wrocław, by e-mail to or using the contact form.

8.4. While submitting a complaint, the Client should provide his/her full name or company name, correspondence address, the type of irregularity connected with the Store functioning, and the date of its occurrence.

8.5. WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa undertakes to consider each complaint within a period of up to 14 days. A failure to consider the complaint within that period signifies the recognition as unjustified.

IX. Protection of Personal Data

9.1. The personal data provided by a Client will be processed by the Seller as the administrator of personal data.

9.2. The Provision of the personal data by a Client is voluntary but necessary to create the Account, to use certain Electronic Services and the conclusion of the Sale Agreement.

9.3. Seller is obliged to implement appropriate technical and organizational measures to protect the processed personal data.

9.4. Any personal information provided by a Client within the Internet Store will be processed by the Seller in specific purposes indicated within each Store form and defined in the Privacy Policy.

9.5. The Client shall be entitled (depending on the use of specific functionality) to lodge a complaint to a specialized data protection authority, to object, to access, rectification, erasure, limit the processing and transfer his or her personal data.

X. Settlement of Disputes and Final Provisions

10.1. A Client who is a Consumer may use extrajudicial ways to handle their complaint and redress. Any disputes about online purchases may be resolved through mediation proceedings before Provincial Inspectorate of the Trade Inspection or proceeding before arbitration courts attached to the Provincial Inspectorate of the Trade Inspection. A Consumer may also use other methods of extrajudicial dispute settlement, e.g. submit a complaint through ODR platform, available at: http://ec.europa.eu/consumers/odr/

10.2. In case the Consumer is not interested to use any of above methods, any disputes arising between WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa and the Consumer shall be settled by a competent court of general jurisdiction in accordance with the Code of Civil Procedure.

10.3. Any dispute arising between WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa and the Client shall be referred for determination to the court having territorial jurisdiction over WASSYL spółka z ograniczoną odpowiedzialnością spółka komandytowa registered office.

10.4. All matters not regulated herein shall be governed by the provisions of the Civil Code, the Act on Rendering Electronic Services as well as other relevant Polish laws.
